Description of Service

Respiro is a breathwork and mindfulness application that provides guided breathing exercises, personalized recommendations, progress tracking, and wellness content. The Service includes:

• Guided breathing sessions with various techniques
• Personalized breathing recommendations
• Progress tracking and statistics
• Mood and journal logging
• Educational articles about breathing and wellness
• Calendar and scheduling features

Account Registration

To access certain features of the Service, you may need to create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these terms.

Free and Pro Subscriptions

Free Plan

The free tier of Respiro provides access to all breathing spaces with a limited number of sessions per space, basic progress tracking, and 7-day session history.

Pro Subscription

Respiro Pro is a paid subscription that provides additional features including:

• Unlimited sessions per space
• Premium environments and visuals
• Ambient soundscapes and binaural beats
• Oxy Autopilot smart scheduling
• Personal breathing journal
• Unlimited session history
• Calendar export and advanced features

Subscription Terms

• Pro subscriptions are billed monthly or yearly as selected
• Subscriptions automatically renew unless cancelled
• You may cancel at any time from your account settings
• Upon cancellation, you retain access until the end of your billing period
• No refunds are provided for partial subscription periods

Free Trial

We may offer a free trial period for new Pro subscribers. At the end of the trial, your subscription will automatically begin unless cancelled. You will be notified before the trial ends.

Price Changes

We reserve the right to change subscription prices. Existing subscribers will be notified at least 30 days before any price change takes effect. You may cancel before the new price applies.

Payment Processing

All payments are processed securely through Stripe. By subscribing to Pro, you authorize us to charge your payment method on a recurring basis. You are responsible for keeping your payment information current.

If a payment fails, we may attempt to charge your payment method again. After multiple failed attempts, your Pro access may be suspended until payment is resolved.

User Conduct

When using Respiro, you agree not to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Upload malicious code or content
• Use the Service for any fraudulent purpose
• Reverse engineer or decompile the application
• Share your account credentials with others

Intellectual Property

The Service and its original content, features, and functionality are owned by Respiro and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. This license does not include:

• Resale or commercial use of the Service
• Modification or derivative works
• Public display or performance
• Downloading or copying content except for personal use

Health Disclaimer

Limitation of Liability

To the fullest extent permitted by law, Respiro and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or other intangible losses
• Damages resulting from unauthorized access to your account
• Damages related to any third-party content or services
• Any health effects from using the Service

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free service
• Accuracy or reliability of any content

Indemnification

You agree to indemnify and hold harmless Respiro, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the Service will cease immediately
• Active subscriptions will not be refunded
• We may delete your account and data

You may terminate your account at any time by contacting us or using the account settings.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms and changing the "Last reviewed" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Respiro operates, without regard to conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
